Rep. Nick Langworthy: “Democrats Can’t Win in Court, so They’re Trying to Break It”

WASHINGTON, D.C. — Republican Study Committee Member Nick Langworthy (NY-23) is calling out Democrat efforts to politicize the Supreme Court in a new op-ed in the Washington Examiner. The piece details how the radical Left’s push to pack the Court with activist liberal judges would threaten judicial independence and turn the Court into a political weapon.

Rep. Langworthy explains how Republicans are fighting back against these efforts with H.J. Res. 1, which proposes an amendment to the Constitution to explicitly require that the Supreme Court of the United States be composed of nine justices. Almost every single House Democrat voted against this resolution. 

Democrats’ opposition to H.J. Res. 1 correlates with the rise of the Democratic Socialists of America (DSA) who have openly advocated for a judiciary subordinate to Congress. Rep. Langworthy warns that this is a sign that the Socialist agenda is being put into action and argues that, without the protection of an independent judiciary, they could move quickly to implement changes that would fundamentally alter the American way of life.

In the piece, Rep. Langworthy writes, “The Supreme Court was never meant to adhere to the fleeting political whims of one party or another. When a Supreme Court decision goes against you, the answer should not be to add more justices until you get the answer you want. America’s Founding Fathers understood that an independent judiciary was essential to preserving our freedoms. That principle was embedded in the Constitution itself. Article III established the Supreme Court as the nation’s highest tribunal for cases and controversies arising under federal law. As the final arbiter of the law, the Court’s fundamental promise to the American people is to provide equal justice under law, independent of Congress or the White House.”

He continues, “More than 150 years later, that stability is under threat. There is a growing effort on the Left to put more justices on the Supreme Court when its decisions don’t produce the outcome they desire. These efforts to pack the Supreme Court with activist liberals would delegitimize and destroy one of the most important institutions in America…The stakes become even clearer when we look at the ideological movement pushing sweeping changes to our way of life as we know it. Socialism, once viewed as a fringe ideology in American politics, has increasingly entered the mainstream of the modern Democratic Party. Recently, the House of Representatives passed H. Res. 1490, a resolution to condemn socialism in all its forms. That vote exposed the troubling reality that the vast majority of Democrats refused to denounce the radical ideology with a record of economic failure, political repression, destruction of individual liberties, and the deaths of over 100 million people worldwide.”

Rep. Langworthy concludes, “Republicans continue to stand by and defend the Constitution and values that have made America the freest and most prosperous nation in the world. Part of that is ensuring our judicial system remains independent and fair. The Democrats’ desire to pack the Supreme Court would subvert the will of the American people and the structure of our constitutional republic. If we amend the Constitution to establish the number of justices at nine, we can ensure our justice system is free from such political coercion. We are in a battle for the soul of America. Protecting the integrity of our judiciary, our government, and Constitution is of paramount importance to the future of our country.”
